Introduction

"CAR CHICK" is the trading name for the CAR CHICK TECHNOLOGY LTD. CAR CHICK operates a platform consisting of a website and mobile application to connect users and offer solutions in the automobile industry within Nigeria and subsequent expansions.

These general terms and conditions shall apply to users on the app/website and shall govern its usage. By proceeding to use our services, you accept these general terms and conditions in full. Do not proceed if you do not accept these conditions.

If you use our platform for business, you undertake as follows:

• Confirm that you have authority to consent to these general terms and conditions;
• Bind both yourself and the company or other legal entity that carries on that business to these general terms and conditions;
• Agree that in these general terms and conditions, references to "you" shall include both the individual user and the relevant person, company, or legal entity unless the context requires otherwise.

Registration and Account

You may not register on our platform if you are under 18 years of age. By using our platform or agreeing to these general terms and conditions, you warrant and represent to us that you are at least 18 years of age.

If you register for an account with our platforms, you will be asked to provide an email address/user ID and password, and you agree to:

• We may suspend or cancel your account and/or edit your account details at any time in our sole discretion and without notice or explanation, provided that if we have reasonable suspicion or reasons to believe you have breached these general terms and conditions, we will refund you in respect of the same.

You may delete your account on our platform by contacting us.

Terms and Conditions of Use

You acknowledge and agree that:

• The platform provides an online location for artisans, mechanics, and other automobile specialists to offer their services, and for motorists/car owners to engage their services;
• A contract for the provision of services will come into force between the users, and you commit to delivering such services accordingly.

Fund Management

Payments made shall be managed by us on the platform through the use of designated in-app wallets for each user. This is to ensure the safety of funds for both users, to ensure that services are rendered before payments, and to ensure that service providers get their payment promptly as soon as confirmation of services is done.

Refunds in respect of excess payment, failure to provide a service, or in case of disputes shall be managed in accordance with our policy on the platform as may be amended from time to time. Our rules on refunds shall be exercised in our discretion subject to applicable laws.

Payments

You must make payments due under these general terms and conditions in accordance with the Payments Information and Guidelines on the platform.

Promotions

Promotions and competitions run by CAR CHICK and/or other promoters shall be managed in accordance with the Promotions Terms and Conditions. You can view each promotion's terms and conditions on our website.

Rules about Your Requests/Qualifications

In these general terms and conditions, your requests/qualifications mean:

• Every demand for a service and description of the exact service needed or issues to be resolved at the time;
• All claims of expertise in a certain field or service being offered.

Your requests and qualifications in accordance with these general terms and conditions must be accurate, complete, and truthful.

Use of Website and Mobile Applications

In this section, "platform" and "website" shall be used interchangeably to refer to CAR CHICK’s websites and mobile applications.

You may:

• View pages from our website in a web browser;
• Download pages from our website for caching in a web browser;
• Print pages from our website for your own personal and non-commercial use, providing that such printing is not systematic or excessive;
• Use our platform services by means of a web browser, subject to the other provisions of these general terms and conditions.

CAR CHICK shall process all personal data obtained through the platform and related services in accordance with the terms of our Privacy and Cookie Notice and Privacy Policy.

Users shall be directly responsible for any misuse of their personal data, and CAR CHICK shall bear no liability to buyers in respect of any misuse by other users of their personal data.

Limitations and Exclusions of Liability

Nothing in these general terms and conditions will:

• Limit any liabilities in any way that is not permitted under applicable law;
• Exclude any liabilities or statutory rights that may not be excluded under applicable law.

Indemnification

You hereby indemnify us and undertake to keep us indemnified against:

• Any and all losses, damages, costs, liabilities, and expenses incurred or suffered by us and arising directly or indirectly out of your use of our platform or any breach by you of any provision of these general terms and conditions or the CAR CHICK codes, policies, or guidelines;
• Any VAT liability or other tax liability that we may incur in relation to any sale transaction made through our platform where that liability arises out of your failure to pay, withhold, declare, or register to pay any VAT or other tax properly due in any jurisdiction.

Law and Jurisdiction

These general terms and conditions shall be governed by and construed in accordance with the laws of Nigeria. Any disputes relating to these general terms and conditions shall be subject to the exclusive jurisdiction of the courts of the territory.
